Terms of service

These terms are the agreement between you and Dream Code Factory GmbH, Dorotheergasse 6-8/14a, 1010 Vienna, Austria, for using bahoe — the website at bahoe.eu, the app at app.bahoe.eu, and the bahoe apps for iOS and Android.

By creating an account you accept them. If you do not, do not create one.

What bahoe is

bahoe helps a group decide whether something is happening. You describe a plan, set a deadline and a minimum number of people, and invite others. They answer. When the deadline arrives the plan tells you whether it is on.

That is the whole service. bahoe is a place to coordinate — it does not organize anything itself, does not sell tickets, does not book anything and is not a party to whatever you and your friends arrange.

Your account

You need an account, and you need a working email address to confirm it. One account belongs to one person. Keep your sign-in details to yourself; anything done through your account is treated as done by you.

You must be 16 or older.

What you put into it

You keep everything you write. You give us permission to store it and to show it to the people you invited — which is what a shared plan is — and to nobody else.

Do not use bahoe to post anything unlawful, to harass anyone, to impersonate anyone, or to send invitations to people who have not agreed to hear from you. Do not try to break into it, overload it, or scrape it.

Other people's plans are not yours to repost. If somebody invites you to something, what you learn from it stays between the people who were invited.

Money

bahoe is free to use for the parts described as free. Paid features are described where you buy them.

bahoe never moves your money. Costs in a plan are a record of who paid what, so a group can settle up between themselves however they already do. bahoe does not transfer, hold or split funds, and takes no position on who owes whom.

If you subscribe, payment is handled by Paddle, acting as merchant of record. Paddle's terms cover the payment itself, and Paddle — not us — is who your card statement names.

You can cancel any time, effective at the end of the period you have paid for. As a consumer in the EU you have a statutory 14-day right of withdrawal on a purchase of digital services; asking us to start the service immediately is what causes that right to lapse once it is fully performed, and you will be told so at checkout.

Ending it

You may delete your account at any time — in the app under Account → Delete your account, or at app.bahoe.eu/delete-account. What that removes and what it keeps is set out in the privacy policy, and it cannot be undone.

We may suspend or close an account that breaks these terms. If we do, we will say why, unless saying so would itself be unlawful.

We may also stop offering bahoe. If that happens you will get reasonable notice and a way to take your plans with you.

What we do not promise

bahoe is provided as it is. We work to keep it available and we run backups, but we do not promise it will never be down, never lose anything, or suit any particular purpose. A deadline that matters should not have bahoe as its only backstop.

We are liable for damage we cause intentionally or by gross negligence, and for injury to life, body or health, without limit. For ordinary negligence we are liable only for breach of an obligation essential to this agreement, and then only for damage that was foreseeable and typical. Nothing here limits any right you have as a consumer under Austrian or EU law that cannot be limited by agreement.

Changes to these terms

We may change these terms. If a change is material you will be told before it takes effect, and continuing to use bahoe after that is acceptance. If you would rather not, delete your account.

Law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, you can sue us and be sued only in the courts of the place where you live, and you keep every protection of your home country's mandatory consumer law. For everyone else, the courts of Vienna have jurisdiction.

The European Commission's online dispute resolution platform is at ec.europa.eu/consumers/odr. We are not obliged and not willing to take part in dispute resolution before a consumer arbitration board.
